Terms of Service

These Terms of Service (“Terms”) are a contract between you and Hong Kong JoyFlix Technology Limited (香港悦影科技有限公司; “ViewSees,” “we,” “us”), Room I-1, 4/F, Golden Dragon Industrial Centre Block 2, 162-170 Tai Lin Pai Road, Kwai Chung, New Territories, Hong Kong. They govern access to viewsees.com, the Studio, the API, and related services (the “Service”). The ViewSees brand is operated by this company. By creating an account, paying for a plan, or using the Service, you agree to these Terms, the Privacy Policy, the Refund Policy, and the Acceptable Use Policy.

1. The Service

ViewSees provides hosted AI video generation: software that turns text prompts, images, and related inputs into short video files. The Service is a digital product delivered online. We do not ship physical goods. Output quality depends on your prompt, source media, and model limits; we do not guarantee a specific creative result.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service for a company, you represent that you have authority to bind that company. The Service is not directed to children.

3. Accounts

You must provide accurate billing information. You are responsible for activity under your account and for keeping credentials confidential. Notify support@viewsees.com if you suspect unauthorized use. We may suspend accounts that are shared in violation of seat limits, that fail payment, or that violate these Terms.

4. Subscriptions, credits, and billing

Paid plans are subscriptions billed in USD in advance. Prices are listed on the Pricing page and may change for future terms with notice. Subscriptions renew automatically at the then-current rate until canceled. One-time credit packs do not renew.

Payments are processed by Stripe, Inc. ViewSees does not store full payment card numbers. By subscribing you authorize Stripe to charge your payment method for the selected plan and any eligible credit packs, plus applicable taxes.

Credits meter GPU renders. Unused subscription credits expire at the end of the billing period unless we state otherwise in writing. Failed payments may be retried. If an invoice remains unpaid, we may pause generation until the balance is cleared.

Cancel anytime before the next renewal by emailing billing@viewsees.com or via the billing portal. Cancellation takes effect at the end of the current paid period. Refunds are described only in the Refund Policy.

5. License to you

Subject to these Terms and your plan, ViewSees grants you a limited, non-exclusive, non-transferable license to access the Service. Starter plans are licensed for personal, non-commercial use. Creator and Studio plans include a commercial license to use generated videos in advertising, websites, social media, and client deliverables, except where prohibited by the Acceptable Use Policy or by law.

You may not resell raw access to the Service, scrape the models, reverse engineer except as allowed by law, or use output to train competing video models.

6. Your content

You retain rights in prompts, uploads, and other inputs you provide (“Input”). You grant ViewSees a worldwide license to host, process, and display Input solely to operate, secure, and improve the Service for you. You represent that you have all rights needed in Input, including likeness and trademark rights.

As between you and ViewSees, you own generated videos (“Output”) created on your account, subject to third-party rights, these Terms, and your plan’s license scope. You are responsible for how you use Output.

7. Prohibited uses

You must follow the Acceptable Use Policy. We may remove content, withhold Output, suspend accounts, and report illegal activity.

8. Intellectual property

The Service, models, software, branding, and documentation are owned by ViewSees and its licensors. These Terms do not transfer those rights. Feedback you send may be used without obligation to you.

9. Third-party services

Checkout, tax calculation, and card processing may be provided by Stripe. Analytics or email tools may process data as described in the Privacy Policy. Their terms apply to those components.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIEWSEES DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT OUTPUT WILL BE UNIQUE, ACCURATE, OR FREE OF THIRD-PARTY CLAIMS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIEWSEES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO VIEWSEES IN THE THREE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

12. Indemnity

You will defend and indemnify ViewSees against claims arising from your Input, your use of Output, your violation of these Terms, or your infringement of another’s rights.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service with reasonable notice where practicable. Sections that should survive (including billing already incurred, licenses already granted for Output on paid plans, disclaimers, and liability limits) will survive.

14. Changes

We may update these Terms. Material changes will be posted on this page and, for paying customers, emailed to the billing address on file. Continued use after the effective date constitutes acceptance. If you do not agree, cancel before the next renewal.

15. Governing law

These Terms are governed by the laws of Hong Kong, excluding conflict-of-law rules. The courts of Hong Kong shall have exclusive jurisdiction, except that ViewSees may seek injunctive relief in any forum. If you are a consumer in a jurisdiction that requires local courts or law, those mandatory rules still apply.
